UNCITRAL Model Law Initiative
We are proud to introduce YCAP's first long-term project, the UNCITRAL Model Law Initiative!
As the up-and-coming generation of Czech arbitration lawyers, we are interested in supporting Czechia in becoming one of the preferred seats of arbitration. The Czech Arbitration Act is rather outdated and in many regards does not function very well especially when compared with some of its leading foreign counterparts. Therefore, the first step towards making Czechia an arbitration-friendly jurisdiction should be a reform of Czech arbitration law. To avoid reinventing the wheel, we consider that implementation of the UNCITRAL Model Law on International Commercial Arbitration (UML) would be the best first step in this endeavor.
Considering the above, YCAP will dedicate a significant part of its activities to supporting the implementation of the UML into Czech law and the reform of Czech arbitration law in general. In the upcoming months, we intend to foster a public discussion among arbitration professionals on the specific modalities of the implementation and seek support for the same among the key stakeholders.
